LEGAL CLAIM

NOTICE: PLEASE READ THESE TERMS & CONDITIONS CAREFULLY. BY ACCESSING THIS WEB-SITE YOU AGREE TO BE BOUND BY THE TERMS & CONDITIONS STATED BELOW. RESERVES THE RIGHT TO CHANGE, MODIFY OR AMEND THESE TERMS AND CONDITIONS WITHOUT ANY NOTICE.

When you place an online order with Fine Print, Inc., you are agreeing to the following terms and conditions.

Please make sure to read and understand all of our policies before placing an order.

PROOFING, COLOR MATCHING & PRINT QUALITY

Fine Print will submit prepress proofs along with original copy for the customer's review and approval. First set of proofs are complimentary, every additional set of proofs will be a charge $35.00 US Dollars. Corrections will be returned to Fine Print on a "master set" marked "0.K.," "0.K. With Corrections" or "Revised Proof Required" and signed by the client. Until the master set is received, no additional work can be performed. Fine Print will not be responsible for undetected production errors if:

Screen (Soft) Proofs

Fine Print does not guarantee color matching or ink density on JPEG or PDF screen proofs. Screen proofs will predict text accuracy, image proportion and placement, but not color or density. Because of differences in equipment, paper, inks, and other conditions between color proofing and production pressroom operations, a reasonable variation in color between color proofs and the completed job is to be expected. When variation of this kind occurs, it will be considered acceptable performance.

Match Prints

A match-print color proof guarantees a reasonable likeness to the final printed pieces. While a match print will accurately predict color, screen pattern and dot placement, a reasonable variation between the match print and the final printed piece is to be expected. When variations of this kind occur, it will be considered acceptable performance. Only a press proof will represent the final print job with one hundred per cent accuracy and no variation.

Press Proof

Press proofs will not be furnished unless they have been required in writing in Fine Print's quotation. A press sheet can be submitted for the client's approval as long as the client is present at the press during make-ready. Any press time lost or alterations/corrections made because of the client's delay or change of mind will be charged at Fine Print's current rates.

FILE SUBMISSION & PREPRESS

Bitmap Resolution

You must provide high-resolution images suited to the offset printing process. Fine Print, Inc. is not liable for images printing as bit maps when this is caused by customers providing low-resolution images.

Color Format

Customers must provide all color printing images in CMYK format. Fine Print, Inc. is not responsible for any color shift that occurs in conversions from RGB to CMYK color modes.

Full Color Black

Full color jobs that contain large solid areas of black ink should have the black set up as CMYK black. Fine Print will not be liable for printing a consistent, solid and rich black if you have not done so.

Duotone

While Fine Print will respect the gradient density of each color in a duo-tone, we are not liable for the final appearance of a duo-tone unless you order a press proof.

Trapping

Trapping is a design function. We will set trapping if we design your documents or if you ask us to do so. Otherwise, Fine Print will assume you have trapped the file correctly. Incorrect trapping will not be grounds for a redo or cancellation unless Fine Print has set trapping.

Text Size

Text smaller than ten points created in Photoshop may print in a pixelated or bit-mapped manner. In such instances Fine Print will not be held liable for bit-mapped text. To avoid this it is best to use programs such as Quark Express, Indesign or Adobe Illustrator to create text. Ordering a match print proof will predict whether bitmap text is a potential problem.

Electronic Manuscripts & Images

It is the client's responsibility to maintain a copy of the original file submitted to the vendor. Fine Print is not responsible for accidental damage to media supplied by the client or for the accuracy of finished or final input. Until digital input can be evaluated by Fine Print, no claims or promises are made about Fine Print's ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating. editing, or programming needed to utilize customer-supplied files will be charged at prevailing rates.

QUOTATIONS & ESTIMATES

A quotation not accepted within 30 days may be changed.

Accuracy of Specifications

Quotations are based on the accuracy of the specifications provided. Fine Print can requote a job at the time of submission if copy, film, tapes, disls, or other input materials do not conform to the information on which the original quotation was based.

Shipping Estimates

Unless otherwise specified, the price quoted is for a single shipment, without storage, F.0.B. Fine Print's platform. Proposals are based on continuous and uninterrupted delivery of the complete order. If the specifications state otherwise, Fine Print will charge accordingly at current rates.

Charges for delivery of materials and supplies from the client to the provider or from the client's supplier to Fine Print are not included in quotations unless specified.

Title for finished work passes to the customer upon delivery to the carrier at the shipping point or upon mailing of invoices for the finished work or a portion thereof,whichever occurs first.

Overruns/Underruns

Overruns or underruns will not exceed 10 percent of the quantity ordered. Fine Print will bill for the actual quantity delivered within this tolerance. If the client requires a guaranteed quantity, the percentage of tolerance must be stated at the time of quotation.

TURNAROUND TIME

Turnaround times begin ONLY when:

  1. Full Payment has been placed with the order.
  2. You have provided all the necessary specifications for the print job.
  3. All files have been correctly submitted.
  4. You have approved an email or press proof and have given the approval to proceed with production.

Printing Schedules

The job will be scheduled with the pre-press production department immediately after order placement. Orders must be submitted by 4 p.m. Eastern Standard Time to be considered to be placed that business day. Orders placed after 4 p.m. will be considered placed on the subsequent business day. A proof will be forwarded to you the next business day after order placement.

Production schedules will be established and followed by both the client and Fine Print. There will be no liability or penalty for delays due to a state of war, riot. civil disorder, fire, strikes, accidents, action of government or civil authority, natural disasters, or other cases beyond the control of the Fine Print. In such cases, schedules will be extended by amount of time equal to the delay incurred.

Expediting Production

If a proof is furnished later than the next business day, print production will be expedited to make up for lost time. If your submission of files delays proofing, Fine Print, Inc. is under no obligation to expedite print production. In this case, late proof delivery will not be considered grounds for job cancellation.

Equipment Failure / Malfunction

Although Fine Print, Inc. follows a strict equipment maintenance program and rarely misses production schedules, unexpected malfunctions and technical problems can occasionally delay the printing and pre-press process. Fine Print will always act to make sure that any production difficulties do not delay delivery schedules.

In case of delay caused by technical difficulty, rush fees will be waived or refunded, however technical difficulty will not be grounds for cancellation. If you cannot use printed material due to missed deadline, a credit will be issued. Refunds will not be issued, with the exception of rush fees.

ORDERS, SHIPPING & DELIVERY

Acceptance of orders is subject to credit approval. Canceled orders require compensation for incurred costs and related obligations.

High Quantities

Shipping rates for high quantity products depend on the customers access to a shipping dock and forklift, otherwise additional charges may apply.

Shipping Delays

Fine Print will always act to make sure that delivery schedules are met. However, in no case shall Fine Print be liable for any consequential or damages resulting from any delay in shipment or delivery. All Fine Print customers agree not to hold Fine Print liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond Fine Print's direct control.

Order Cancellation

Fine Print will be happy to help you cancel your order prior to Approval. However, orders may be eligible for cancellation upon request via email. Our Customer Service Team will inform you of any cancellation charges depending on the stage of the order.

If job is canceled any labor hours (proof, graphics design, etc.) or administrative fees (credit cards fees, etc.) will be subtracted from your refund. Minimum is $15 ( 15%-30% of total transaction )
Once the order has been placed successfully, No Refunds are issued for the Logo, and Graphic design services.

Shipping Errors & Lost Packages

Lost or damaged claims can only be filed for shipments over $50.00 in value and can only be done after 30 days from package shipment. Fine Print is not responsible for 3rd party shipping errors, omissions or damaged shipments.

Customer Supplied Incorrect Address

When a package is not delivered due to an error made by the customer in submitting the proper shipping address, Fine Print will reship the package with corrected address and charge an additional shipping fee for the shipment.

USE AND PROTECTION OF PERSONAL INFORMATION

Fine Print, Inc. is committed to protecting your privacy. We will collect or record basic personal information (e.g., name, e-mail address, mailing address, phone number) you voluntarily provide through the "The Information Request" page or through electronic mail you send to us, but we will not disclose this information to third parties.

We also may ask you questions about your buying habits for particular product segments, or ask you to state the total dollar volume spent on a particular product. We will not otherwise collect or record any of your personally identifiable information.

To enable us to assess the effectiveness and usefulness of this site, we will collect and store aggregated data on the pages viewed by visitors, visitors' domain names and similar information, but will not identify you personally in the aggregated information and will not share aggregated information with others.

LIMITATION OF LIABILITY

In no event shall Fine Print or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not Fine Print has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from Fine Print or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service.

Unauthorized Use

In no event shall Fine Print be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.

We reserve the right to refuse service without disclosing a reason.

Customer's Property

Fine Print will only maintain fire and extended coverage on property belonging to the client while the property is in the Fine Print's possession. Fine Print's liability for such property will not exceed the amount recoverable from the insurance. Additional insurance coverage may be obtained if it is requested in writing and if the premium is paid to Fine Print.

PROPERTY RIGHTS & USAGE

Experimental Work

Experimental or preliminary work performed at the client's request will be charged to the client at Fine Print's current rates. This work may not be used without Fine Print's written consent.

Creative Work

Sketches, copy, dummies, and all other creative work developed or fumished by Fine Print are the Fine Print's exclusive property. Fine Print must give written approval for all use of this work and for any derivation of ideas from it.

ADDITIONAL CHARGES & CONDITIONS

Alterations/Corrections

Client alterations include all work performed in addition to the original specifications. All such work will be charged at Fine Print's current rates.

Storage

Fine Print will retain intermediate materials used until the related end product has been accepted by the client. If requested by the client, intermediate materials will be stored for an additional period at an additional charge. Fine Print is not liable for any loss or damage to stored material beyond what is recoverable bv Fine Print's fire and extended insurance coverage.

Taxes

All taxes and assessments levied bv any governmental authority are the responsibility of the client. All amounts due for taxes and assessments will be added to the client's invoice. No tax exemption will be granted unless the customer's "Exemption Certificate" (or other official proof of exemption) accompanies the purchase order. If, after the client has paid the invoice, it is determined that more tax is due, then the customer must promptly remit the required taxes to the
taxing authority or immediately reimburse Fine Print for any additional taxes paid.

Telecommunications

Unless otherwise agreed, the client will pay for all transmission charges. Fine Print is not responsible for any errors, omissions, or extra costs resulting from faults in transmission.

Customer-Furnished Materials

Materials furnished by client's or their suppliers are verified by delivery tickets. Fine Print bears no responsibility for discrepancies between delivery tickets and actual counts. Client supplied paper must be delivered according to specifications furnished by Fine Print.

These specifications will include correct weight, thickness, pick resistance, and other technical requirements. Artwork, film, color separations, special dies, tapes, disks, or other materials furnished by the client must be usable by Fine Print without alteration or repair. Items not meeting this requirement will be repaired by the client or by Fine Print at Fine Print's current rates.

Outside Purchases

Unless otherwise agreed in writing, all outside purchases as requested or authorized by the client, are chargeable.

PAYMENT

Payment is cash in advance or whatever has been agreed to between client and Fine Print. Claims for defects, damages, or shortages must be made by client in writing no later than 10 calendar days after delivery. If no such claim is made, Fine Print and the client will understand that the job has been accepted.

By accepting the job, the client acknowledges that Fine Print's performance has fully satisfied all terms, conditions, and specifications. Fine Print's liability will be limited to the quoted selling price of defective goods without additional charge for special or consequential damages.

As security for payment of any sum due under the terms of an agreement, Fine Print has the right to hold and place a lien on all client property in Fine Print's possession. This right applies even if credit has been extended, notes have been accepted, trade acceptances have been made, or payment has been guaranteed.

If payment is not made, the customer is liable for all collection costs incurred.

LIABILITY

Disclaimer of Express Warranties

Fine Print warrants that the work is as described in the purchase order. The client understands that all sketches, copy, dummies, and preparatory work shown to the client are intended only to illustrate the general type and quality of the work. They are not intended to represent the actual work performed.

Disclaimer of Implied Warranties

Fine Print warrants only that the work will conform to the description contained in the purchase order. Fine Print's maximum liability, whether by negligence, contract, or otherwise, will not exceed the retum of the amount invoiced for the work in the dispute. Under no circumstances will Fine Print be liable for specific, individual, or consequential damage

Copyrights

The client also warrants that the subject matter to be printed is not copyrighted by a third party. The client also recognizes that because subiect matter does not hare to bear a copyright notice to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce.

The client further warrants that no copyright notice has been removed from any material used in preparing the subject matter for reproduction. To support these warranties, the client agrees to indemnify and hold Fine Print harmless for all liability, damages, and attorney fees that may be incurred in any legal action connected with copyright infringement involving the work produced or provide

Personal or Economic Rights

The client also warrants that the work does not contain anything that is libelous or scandalous or anything that threatens anyone's right to privacy or other personal or economic rights. The client will at the client's sole expense, promptly and thoroughly defend fine Print in all legal actions on these grounds as long as Fine Print:

As the provider, Fine Print reserves the right to use its sole discretion in refusing to print anything it deems libelous, scandalous, improper, or infringing on copyright law.

INDEMNITY

The client agrees to protect Fine Print from economic loss and any other harmful consequences that might arise in connection with the work. This means the client will hold Fine Print harmless and save, indemnify, and otherwise defend Fine Print against claims, demands, actions, and proceedings on any and all grounds. This will apply regardless of responsibility for negligence.

Venue

In the event of suit regarding this contract, the venue and jurisdiction thereof shall be in either the Superior or Municipal Court, as appropriate, of the County of Manhattan, New York. The parties agree and stipulate that the essential terms of this
